Welcome to mydrink (“we”, “us”, “our”). By accessing or using our website and related services (the “Services”), you agree to these Terms of Service. If you do not agree, please do not use the Services.

Who we are

mydrink is a Kenya-oriented online store for wine, spirits, beer, and related drinks. You must be at least 18 years old to purchase alcohol. We may require proof of age on delivery. Contact: support@mydrink.co.ke.

Use of the site

You agree to use the Services only for lawful purposes and in line with these terms and any notices we publish. You must not misuse the site (for example by attempting to interfere with security, scrape content in bulk without permission, or use automated means in a way that harms our systems or other users).

We may suspend or restrict access where we reasonably believe there is a breach of these terms or a risk to the Services or other customers.

Accounts

If you create an account, you are responsible for keeping your login details confidential and for activity under your account. Notify us promptly at the email above if you suspect unauthorised use.

Orders, pricing, and availability

Product descriptions, images, and prices are shown as accurately as we can. All prices are in Kenya Shillings (KES). Offers and stock levels can change. Items in your cart are reserved for a limited time during checkout; a reservation is not a completed purchase until payment is confirmed. We may refuse or cancel an order (for example if an item is unavailable, there is an obvious pricing error, or we cannot verify payment). If we cancel after payment, we will refund you using the same route where practicable.

Payments

Payments are processed securely by Paystack, which supports payment methods shown at checkout (including cards and M-Pesa). By initiating a payment, you authorise the charge for your order total. Paystack operates under its own terms and network rules; we do not store your full card number or mobile-money PIN on our servers.

You are responsible for ensuring the phone number or card you use is correct and that you complete any prompts on your device. Failed or reversed payments may delay or cancel fulfilment until the payment is successfully settled.

Alcohol sales

Alcohol is sold only to customers aged 18 and above, in line with the Alcoholic Drinks Control Act and other applicable Kenyan law. By placing an order you confirm you meet the legal drinking age. We support responsible drinking and do not sell to intoxicated persons. Delivery drivers may refuse handover without valid ID, and the order may be cancelled in line with our Refunds & Returns Policy.

Delivery and returns

Delivery times and options (including pickup points, where offered) are estimates and may depend on carriers and your location in Kenya. Our Refunds & Returns Policy explains how cancellations, damaged or incorrect items, and refunds are handled. Statutory rights that apply in Kenya, including under the Consumer Protection Act, 2012, are not limited by these terms except where the law allows.

Intellectual property

Content on the Services (including text, graphics, logos, and layout) is owned by mydrink or our licensors. You may not copy, modify, or distribute it without our permission except as allowed by law or for personal, non-commercial browsing.

Disclaimer and limitation of liability

The Services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not guarantee that the site will be uninterrupted or error-free.

To the extent permitted by applicable law in Kenya, we are not liable for any indirect, incidental, special, or consequential losses, or for loss of profit, data, or goodwill, arising from your use of the Services. Our total liability for claims arising out of or related to these terms or the Services is limited to the amount you paid to us for the relevant order (or, if no purchase applies, a reasonable cap where the law allows such a cap). Nothing in these terms excludes or limits liability that cannot legally be excluded or limited (including liability for death or personal injury caused by negligence where applicable).

Changes

We may update these terms from time to time. The “Last updated” date will change when we do. Continued use of the Services after changes means you accept the revised terms. Material changes may also be signposted on the site or by email where appropriate.

Governing law

These terms are governed by the laws of Kenya, subject to mandatory consumer protections that apply to you.
